1. Acceptance of Terms

By accessing or using AI Baby, you confirm that:

You have read, understood, and agree to these Terms
You will use the Services only for lawful and entertainment purposes

2. Description of Services

AI Baby is an entertainment platform that allows users to:

Upload two photos (typically of a couple)
Choose a baby's gender (boy or girl) and age (1, 3, or 7 years old)
Generate AI-created baby photos or videos with sound

Important Disclaimer:

AI Baby is for entertainment purposes only
Generated results are artistic renderings and do not predict actual genetics, appearance, or characteristics of any real child
AI Baby does not provide medical, genetic, or scientific predictions

3. User Responsibilities

You agree to:

Upload only photos you have the legal right to use
Use the Services in compliance with all applicable laws and regulations
Not upload content that is illegal, harmful, abusive, defamatory, or violates third-party rights
Not use AI Baby for any discriminatory, malicious, or deceptive purposes
Accept full responsibility for all activity under your account

4. Intellectual Property and Ownership

4.1 Service Ownership

All rights, title, and interest in the AI Baby platform (including software, branding, design, and algorithms) remain with AI Baby and our licensors.

4.2 User Content

You retain ownership of the photos you upload
By uploading photos, you grant AI Baby a limited, temporary license to process them solely for generating AI Baby results
All uploaded photos are automatically deleted after processing (see Privacy Policy)

4.3 Generated Content

You retain rights to download and use your generated AI Baby photos and videos for personal, non-commercial purposes
You may not use generated content to misrepresent real individuals or imply genetic predictions
AI Baby retains the right to use anonymized, aggregated data to improve our services

5. Payment, Credits, and Refunds

5.1 Pricing

AI Baby operates on a credit-based system
Each AI Baby photo generation costs 5 credits
Each AI Baby video generation costs 15 credits
Credit packages are clearly displayed on our pricing page

5.2 Payment Processing

All payments are processed securely through Stripe
We do not store your payment card information
All fees are stated in USD and are subject to applicable taxes

5.3 Refund Policy

Credits are non-refundable once purchased
We do not issue refunds for unused credits, mistaken purchases, or dissatisfaction with AI-generated outputs
Refunds may be granted only in cases of verified technical errors that prevent service delivery

5.4 Pricing Changes

We reserve the right to modify pricing with 30 days' notice to existing users.

6. Prohibited Uses

You agree NOT to:

Use AI Baby for unlawful, harmful, fraudulent, or abusive purposes
Upload photos of minors without parental consent
Upload photos you do not have legal rights to use
Create content that is defamatory, discriminatory, obscene, or violates third-party rights
Reverse-engineer, modify, or attempt to access AI Baby's underlying systems or algorithms
Use automated systems (bots, scrapers) to access the Services without permission

Violation of these terms may result in immediate account suspension or termination.

7. Disclaimer of Warranties

AI Baby is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We make no guarantees regarding:

The accuracy, realism, or quality of AI-generated results
Uninterrupted or error-free operation
Compatibility with all devices or browsers
The suitability of results for any particular purpose

AI Baby does NOT:

Predict actual genetics or appearance of real children
Provide medical, scientific, or genetic advice
Guarantee specific outcomes or resemblances

8. Limitation of Liability

Why this matters: AI Baby is an entertainment service. This clause protects both you and us by setting fair and reasonable limits on legal liability.

8.1 General Limitations

To the maximum extent permitted by law:

AI Baby shall not be liable for any indirect, incidental, consequential, or punitive damages (such as emotional distress, lost opportunities, or relationship issues) arising from your use of the Services
Our total liability for any claim shall not exceed the greater of:
- The amount you paid for the Services in the past 12 months, OR
- $100 USD

8.2 Exceptions

This limitation does NOT apply to:

Damages caused by our gross negligence or willful misconduct
Liability for personal injury or death caused by our negligence
Any liability that cannot be excluded under applicable law (such as EU consumer protection regulations, GDPR requirements, or other mandatory consumer rights)

8.3 Third-Party Services

We are not responsible for failures or issues arising from third-party services (such as Stripe payment processing, hosting providers, or CDN services) unless directly caused by our actions or negligence.

8.4 Data Security and Breach Notification

In the event of a data breach:

We will notify affected users within 72 hours as required by applicable law
We will take immediate action to secure our systems
We will provide reasonable assistance and cooperation as required by law

However, we are not liable for damages resulting from sophisticated cyberattacks or unauthorized third-party intrusions that bypass industry-standard security measures, unless caused by our gross negligence.

9. Account Termination

9.1 Termination by AI Baby

We may suspend or terminate your account if you:

Violate these Terms of Service
Engage in fraudulent or abusive behavior
Upload illegal or harmful content

9.2 Termination by User

You may stop using AI Baby at any time. Unused credits are non-refundable upon account closure.

10. Changes to Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect the most recent version. Continued use of AI Baby after changes constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution
